Justin Ruben, Executive Director of MoveOn.org Political Action, has requested the U.S. Department of Justice to “initiate an investigation into whether the Republican nominee for President, former Massachusetts Governor Mitt Romney, violated the False Statements Act… for stating unequivocally, on his personal financial disclosure form… that he was ‘not involved in the operations of any Bain Capital entity in any way’ after February 12, 1999.”

As explained in detail in a memo prepared by the MoveOn.org Political Action counsel, “there is substantial evidence that Governor Romney was in fact involved in the operations of Bain Capital entities after that date. Indeed, it is undisputed that Gov. Romney was the sole director, Chief Executive Officer and President of Bain Capital, Inc. at least through the middle of 2000. The notion that he occupied these positions with absolutely no involvement in the operations of Bain Capital Inc. is inconsistent with the requirements of applicable law and the reported facts concerning his relationship to Bain at that time.

“The purpose of requiring candidates to file a personal financial disclosure form, under the Ethics in Government Act, is to ensure that the electorate is fully informed about the financial interests and fiduciary and other positions of the candidates. For a candidate to make misrepresentations on that form is not only a federal crime but a serious breach of the public trust.”

“Mitt Romney paid an effective tax rate of 14.1 percent in 2011, according to a tax return filed on Friday, a relatively low tax rate resulting from exotic deductions, the special tax treatment for his Bain Capital retirement package and the low tax rate on capital gains. Romney also opted not to deduct millions in charitable contributions from his tax bill in order to maintain a pledge from August that he has paid at least 13 percent in federal income taxes for each of the past 10 years.

“If the American people reject him at the polls in November—and even if they don’t—Romney would be fully within his legal rights to file an amended return, requiring the Treasury to cut him a substantial check.”

“‘It’s noble,’ said Boston College tax law professor Brian Galle of Romney’s generous, if temporary, gift to the Treasury. ‘It also doesn’t prevent him from taking that deduction in an amended return if he were to file it after the election.’”

“Romney has asserted the he does not believe in paying more taxes than required. ‘I don’t pay more than are legally due, and frankly, if I had paid more than are legally due I don’t think I’d be qualified to become president. I’d think people would want me to follow the law and pay only what the tax code requires.’”

Thank you, Mr. Romney, for telling us that you are not qualified to become president. We were starting to wonder.
